juries... let's talk about them...
what are they? who are they? where are they?
i bet these are all questions you're asking... and i'm here to answer all of them.
- they are randomly selected...
- are there to support a judge...
- they should have no connection or prior knowledge to case to remove bias
- if everyone on the jury agrees to a verdict it is unaminous
- a jury's decision HAS to be unanimous
- they sit on the (left?) side of the court
- every australian citizen has the potential to be on a jury although some could be disqualified or excused if:
- they have an important event to attend, e.g.
- school exams
- birth of child
- sick
- they're aware of case/inside knowledge
- related to people
- cannot be under 18
- cannot be criminals
- cannot be associated with law/government
- juries can be veto'd/chosen by either party for many reasons, such as people being chosen that'd be more likely to agree on one of their standpoints
- e.g. men are more likely to excuse SA charges
- 12? 10? -- number of jurors can vary, but around 10-12, depending on the case
- the aim is to see concensus of the normal person/local society to have a wider society perspective on the case which can remove some bias in a sense
- usually at criminal cases that are usually serious
- picked from 'local area -- surrounding areas
